Both the recent 'Warner' review of the UK research ethics committee (REC) system and the subsequent consultation document produced by the Central Office for Research Ethics Committees (COREC) emphasize the need to distinguish 'research' from what might be termed 'non-research'. This is to be determined through a process of filtering or 'triage', the intention being that RECs will avoid considering proposals with 'no material ethical issues'. In this paper we argue that trying to distinguish 'true' research from other projects is (...) counterproductive, misleading and potentially unethical. Our case is built around three assertions: (1) the distinction between research and non-research is imprecise; (2) both medical research and non-research can generate similar ethical issues; and (3) projects should be judged according to what they involve, not how they are labelled. Recent policy in relation to clinical research proposals in the UK has distinguished between two types of review: scientific and ethical. This distinction has been formally enshrined in the recent changes to research ethics committee structure and operating procedures, introduced as the UK response to the EU Directive on clinical trials. Recent reviews and recommendations have confirmed the place of the distinction and the separate review processes. However, serious reservations can be mounted about the science/ethics distinction and the policy of (...) separate review that has been built upon it. We argue here that, first, the science/ethics distinction is incoherent, and, second, that RECs should not only be permitted to consider a study’s science, but that they have anobligation do so. "Like H. H. Price, who said that 'Clarity is not enough' in the intellectual realm, we may say that clarity is all the less sufficient in the ethical realm." Indeed few will want to reproach this author with overvaluing clarity or with placing excessive emphasis on precision. He constantly prefers the suggestive to the exact. Though the book deals with ethical questions, the aim is not to present a general theory of ethics, but to derive ethical and political consequences from (...) the phenomenology of man. What, in fact, emerges is a loosely related series of studies, which have in common the primacy of the concrete subject. The first part of the book is devoted to a phenomenological ontology of the concrete subject. The conclusions are not novel, but they do provide a necessary background for the later studies. The second part of the book considers ethical questions, and presents an interesting trichotomy of values into embodied values, such as holiness as embodied in God; values which are never realized once and for all and which require repeated actualization, such as charity; and values which must be protected and fortified, such as political liberty. Also included are studies of the ethical aspects of lying and of being ashamed. Rotenstreich claims that lying is morally reprehensible because truth is an ethical value. To support this latter contention, he argues that truth is demanded by rationality, the essence of man, and that man has a duty to develop his essence. The views of Ziff in this collection of essays are always challenging and frequently are marked by brilliant insight. Thirteen essays are found in this volume, all of which had been previously published, with the exception of "Truth in Poetry," in which Ziff argues that it is not appropriate to ask if what a poem says is true since poems are not statements. The essays can be divided into three groups, the first group dealing with aesthetics, the second group treating (...) of topics in the philosophy of language, and the third dealing with the philosophy of mind. Also included is an essay "About God." The five essays in aesthetics, which take up roughly half the book, constitute one of the most distinguished bodies of work in contemporary analytic aesthetics. Besides "Truth and Poetry," this group contains "Art and the Object of Art," in which Ziff argues that art is not an illusion, and "Reasons in Art Criticism" in which he tries to determine what is acceptable as a reason why a painting is good. Also included is an essay in which Ziff seeks to give a plausible characterization of pictorial representation and one examining some of the problems in defining a work of art. The four essays in the philosophy of language supplement the author's Semantic Analysis. They are largely concerned with exploring the boundary between syntax and semantics. There is an essay examining ungrammaticalness and one examining how ungrammatical sentences can be understood. Another treats of ambiguity while the fourth attempts to show that active and passive sentences are not synonymous. The essays in the philosophy of mind are a much less well-knit group. The three essays take up the problem of other minds, the feeling of robots and an argument against behaviorism. The chief value of this collection is in gathering together Ziff's important contributions in the field of aesthetics. It also has value for its stimulating and original thought in other fields. This book discusses how rational choice theory grew out of RAND's work for the US Air Force. It concentrates on the work of William J. Riker, Kenneth J. Arrow, James M. Buchanan, Russel Hardin, and John Rawls. It argues that within the context of the US Cold War with its intensive anti-communist and anti-collectivist sentiment, the foundations of capitalist democracy were grounded in the hyper individualist theory of non-cooperative games.

Physician-written “do not resuscitate” DNR orders elicit negative reactions from stakeholders that may decrease appropriate end-of-life care. The semantic significance of the phrase has led to a proposed replacement of DNR with “allow natural death” . Prior to this investigation, no scientific papers address the impact of such a change. Our results support this proposition due to increased likelihood of endorsement with the term AND.

The article argues that Kant’s argument for ownership entails a standard of meaningful use by which property regimes can be evaluated: a regime must make it possible for usable objects to be meaningfully used. A particular form of fully communal ownership can satisfy this standard. Further, this form of communal ownership is compatible with Kantian freedom more broadly. I conclude that, if this is so, there is a great deal of space for further consideration of the rightfulness of diverse regimes (...) of ownership and exchange within a Kantian framework. (shrink)

There is general acknowledgement that both the anterior cingulate and orbitofrontal cortex are implicated in reinforcement-guided decision making, and emotion and social behaviour. Despite the interest that these areas generate in both the cognitive neuroscience laboratory and the psychiatric clinic, ideas about the distinctive contributions made by each have only recently begun to emerge. This reflects an increasing understanding of the component processes that underlie reinforcement- guided decision making, such as the representation of reinforcement expectations, the exploration, updating and representation (...) of action values, and the appreciation that choices are guided not just by the prospect of reward but also by the costs that action entails. Evidence is emerging to suggest that the anterior cingulate and orbitofrontal cortex make distinct contributions to each of these aspects of decision making. (shrink)

Genomic research results and incidental findings with health implications for a research participant are of potential interest not only to the participant, but also to the participant's family. Yet investigators lack guidance on return of results to relatives, including after the participant's death. In this paper, a national working group offers consensus analysis and recommendations, including an ethical framework to guide investigators in managing this challenging issue, before and after the participant's death.

To many who develop and use free software, the GNU General Public License represents an embodiment of the meaning of free software. In this paper we examine the definition and meaning of free software in the context of three events surrounding the GNU General Public License. We use a case involving the GPU software project to establish the importance of Freedom 0 in the meaning of free software. We analyze version 3 of the GNU General Public License and conclude that (...) although a credible case can be made that the added restrictions are consistent with the definition of free software, the case requires subtle arguments. Strong arguments against the added restrictions are less subtle, and may therefore be more convincing to many users and developers. We also analyze the Affero General Public License and conclude that it is inconsistent with the definition of free software. (shrink)

This paper attempts a partial, critical look at the construction and use of case studies in ethics education. It argues that the authors and users of case studies are often insufficiently aware of the literary nature of these artefacts: this may lead to some confusion between fiction and reality. Issues of the nature of the genre, the fictional, story-constructing aspect of case studies, the nature of authorship, and the purposes and uses of case studies as "texts" are outlined and discussed. Is there really an ethical crisis? We propose that the situation is not as bad as many would have us believe. We have attempted to present an alternative explanation for some earlier reports of an ethical crisis. This has resulted in a number of research propositions. We are optimistic that there are, in spite of reports to the contrary, an overwhelming majority of ethical people populating our business community.

The author congratulates Dr Brian Hurwitz, who recently reported the successful “intimidation” of an elderly competent widow into accepting badly needed therapy for a huge ulcerated carcinoma. He reports approvingly of the Israeli Patients' Rights Law, enacted in 1996, which demands detailed informed consent from competent patients before permitting treatment. But the law also provides an escape clause which permits coercing a competent patient into accepting life-saving therapy if an ethics committee feels that if treatment is imposed the patient will (...) give his/her consent retroactively. He suggests this approach as an appropriate middle road between overbearing paternalism and untrammelled autonomy. (shrink)

The fertilizing ability of spermatozoa is inhibited by certain substances present in the seminal fluid. Most of these antifertility factors are proteinaceous in nature and differ in their physical characteristics. They inhibit fertilization by inhibiting either motility, capacitation, acrosome reaction or penetration of the ovum investments by the spermatozoa. This review describes and discusses the properties of these factors and their possible role, individually and collectively, in the regulation of fertility.

Rationing healthcare is a difficult task, which includes preventing patients from accessing potentially beneficial treatments. Proponents of implicit rationing argue that politicians cannot resist pressure from strong patient groups for treatments and conclude that physicians should ration without informing patients or the public. The authors subdivide this specific programme of implicit rationing, or “hidden rationing”, into local hidden rationing, unsophisticated global hidden rationing and sophisticated global hidden rationing. They evaluate the appropriateness of these methods of rationing from the perspectives of (...) individual and political autonomy and conclude that local hidden rationing and unsophisticated global hidden rationing clearly violate patients’ individual autonomy, that is, their right to participate in medical decision-making. While sophisticated global hidden rationing avoids this charge, the authors point out that it nonetheless violates the political autonomy of patients, that is, their right to engage in public affairs as citizens. A defence of any of the forms of hidden rationing is therefore considered to be incompatible with a defence of autonomy. (shrink)

While there are many points of opposition between the political philosophies of Marx and Kant, the two can greatly benefit from one another in various ways. Bringing the ideas of Marx and Kant together offers a promising way forward for each view. Most significantly, a powerful critique of capitalism can be developed from their combined thought: Kant’s political philosophy offers a robust idea of freedom to ground this critique, while Marx provides the nuanced understanding of social and political power structures (...) under capitalism that allows this idea of freedom to be properly applied. The attitudes of women patients with cancer were explored when they were invited to participate in one of three randomised trials that included chemotherapy at two university centres and a satellite centre. Fourteen patients participating in and 15 patients declining trials were interviewed. Analysis was based on the constant comparative method. Most patients voiced positive attitudes towards clinical research, believing that trials are necessary for further medical development, and most spontaneously argued that participation is a moral obligation. Most trial decliners, (...) however, described a radical change in focus as they faced the actual personal choice. Almost no one got an impression of clinical equipoise between treatments in the trials, and most patients expressed discomfort with randomisation. A patient’s choice to participate was mainly determined by whether the primary focus was on treatment effect or on adverse effects. Both knowledge about and feelings towards trials originated mostly from the media, although paradoxically the media were largely seen as untrustworthy. Mistrust was shown towards the pharmaceutical industry, and although most patients originally trusted that doctors primarily pursued the interest of patients, they did not trust the adequacy of doctors or industry in maintaining self-regulation. The Greek original of Galen's is lost, nor has a copy of the complete translation into Arabic, made by Hunayn b. Ishāq in the first half of the ninth century, come down to us, though some passages of it are quoted by various Arab authors. A summary of the translation, however, was discovered by P. Kraus in a miscellaneous manuscript in Cairo and published by him in the Bulletin of the Faculty of Arts of the University of Egypt, vol. v/i.

The quantum probability flux of a particle integrated over time and a distant surface gives the probability for the particle crossing that surface at some time. We prove the free fluxacross-surfaces theorem, which was conjectured by Combes, Newton and Shtokhamer [1], and which relates the integrated quantum flux to the usual quantum mechanical formula for the cross section. The integrated quantum flux is equal to the probability of outward crossings of surfaces by Bohmian trajectories in the scattering regime.

In Pure Inductive Logic, the rational principle of Predicate Exchangeability states that permuting the predicates in a given language L and replacing each occurrence of a predicate in an L-sentence phi according to this permutation should not change our belief in the truth of phi. In this paper we study when a prior probability function w on a purely unary language L satisfying Predicate Exchangeability also satisfies the principle of Unary Language Invariance.
